COMPANY FORMATION IN PORTUGAL

Set up your company in Portugal - and do business throughout Europe.

To start doing business in Portugal, or even to create effective ties with the country, the most appropriate way is to set up a company (legal entity) under Portuguese law.

This company not only immediately gives your business a credible status, but being Portuguese, it shows that your business already exists in Portugal.

A Portuguese company can make contracts, sell to Europe, obtain loans, benefit from state aid (European Community funds), hire people, rent or buy property.

Our Brazilian office, through lawyers, provides support throughout the process.

You can set up a company under Portuguese law without powers of attorney, extra costs for accommodation and travel.

Portugal as a privileged partner of the United States

Given the extremely close and historically friendly relationship between Portugal and the United States of America, which dates back to the time of North American independence, Portugal was the third country to recognize the new North American nation, even before the peace treaties or the Paris treaties.

There are several colonies of Portuguese descendants with extensive roots in New Jersey, Connecticut, California and Hawaii, who today have become leading politicians and businesspeople in North American society.

In this way and through multiple instances and instruments, collaboration and cooperation is very intense. 70 years ago, at the invitation of the USA, Portugal became a founding member of NATO.

For all these reasons, holders of Portuguese nationality can immediately benefit from the E-2 visa for the United States.

The E-2 visa, although temporary, can be renewed and ends up functioning as a permanent residence visa and is the appropriate visa for those who want to reside in the United States and also intend to do business or invest there.

In addition to the individual, the Visa covers the spouse and dependent minor children, who may in turn work in the US and have legal US documents.

This Visa involves an investment of around 100,000 USD and is available to those who, being Portuguese citizens, correctly make the necessary applications and requests.

Bank account

For a Brazilian to open a bank account in Portugal, from Brazil, he/she will have to do so as a non-resident in Portugal. Opening a bank account in Portugal for a non-EU citizen is not always an easy task, given the lack of options and obstacles placed by some banks. However, there are options and legal ways to adapt the customer's intentions to the legal requirements of Portuguese banks and the European Central Bank (ECB, which governs the entire euro zone).

A Brazilian or non-resident in Portugal can open a bank account in Portugal. The documents normally required to open an account as a non-resident in Portugal are:

  • Passport or other accepted identification document

  • Portuguese NIF

  • Proof of address

  • Proof of income

These are just some of the necessary elements. All Portuguese banks are subject to compliance rules and are very demanding when it comes to customer verification - KYC Know Your Customer.

KYC stands for “Know Your Customer” and refers to the process of verifying a customer’s identity and assessing their risk profile before doing business with them. Banks have a compliance department to prevent financial crimes such as money laundering, fraud, and terrorist financing.

For these reasons, opening a bank account in Portugal is not an automatic or administrative process, and it is appropriate to have the correct presentation of documents, as well as the personalized presentation and introduction of the client to a given bank.

We have a direct relationship with several banks, where we endorse and introduce our clients in a personalized manner and according to their profile.

The choice and presentation of the client aims not only to ensure that the account is quickly and effectively opened, but also that the profile of both is suitable.

The profile of someone who simply wants to save money in Portugal is not the same as that of someone who wants to buy property in Portugal. Nor is it the same profile of someone who wants to invest and do business in Portugal and needs constant professional support.

We work with the main banks on the market, and we build the right bridges for our clients’ success.
